  1. *Trvalým příkazem na účet Poskytovatele vedený u GE Money Bank, a. s.: 217616041/0600 Variabilní symbol: $C_SMLOUVY$ konstantní symbol: 0308 a to do 14. dne daného kalendářního měsíce.
  2. *Složenkou Č. P. na účet Poskytovatele vedený u Moneta Bank a.s.: 217616041/0600 Variabilní symbol $C_SMLOUVY$  s konstantním symbolem: 0309, a to nejpozději do 15. dne každého kalendářního měsíce,
  3. *Hotově proti příjmovému dokladu v úřední hodiny na pražské pobočce Poskytovatele nejpozději do dne splatnosti faktury.
  4. Převodem proti přijaté faktuře nejpozději do dne splatnosti, na uvedený variabilní symbol faktury a s konstantním symbolem 0308, tak aby v den splatnosti byly poukazované částky na účtu Poskytovatele.
  5. Složením hotovosti na kterékoliv pobočce GE Money Bank, a. s. na č. Účtu: 217616041/06 Nutno uvést Variabilní symbol faktury, nebo č. smlouvy: $C_SMLOUVY$
  6. U úhrad z předešlých bodů 1) – 5) se VŽDY za den úhrady považuje den připsání finančních prostředků na účet Poskytovatele.
  7. Smluvní pokuty za neuhrazení nebo pozdní platby jsou uvedeny ve všeobecných podmínkách, odst. VII.
  8. V případě neidentifikované platby s nesprávně uvedeným variabilním symbolem, bude tato pohledávka považována za nezaplacenou a služby mohou být omezeny.
  9. Garantovaný objem dat znamená, kolik kByte/min (info pro ČTÚ objem stažených dat) je možno stáhnout za jednotku času. Jedná se o číslo, které požaduje ČTÚ a odpovídá násobku garantované rychlosti, vynásobené 8 (info pro ČTÚ 1Byte = 8bit) krát čas po který stahujete. Číslo zde uvedené je garantováno v čase, pouze pokud je protější Server SCHOPEN tuto rychlost v čase stabilně poskytnout. Pro různá stahování je tento údaj pouze informativní, neboť stahovací Servery v Internetu tyto rychlosti samozřejmě nikdy negarantují a provoz v Internetu jako takový není v principu nikdy garantován.
    Ale Vaše připojení tyto rychlosti garantuje. Při jakékoli záporné odchylce (snížení stahování objemu dat) se jedná o poruchový stav a zákazník má nárok na procentní snížení ceny, tedy reklamaci služby. Zákazník si musí být vědom toho, že jak výše uvedeno, ne včechny Servery v Internetu rychlosti garantují.
  10. Zákaznk má právo na vrácení poměrné částky za sníženou propustnost do internetu nebo trvalé snížení služby, pokud tato nesplňuje podmínky v odstavci Garantovaný objem stažených dat kByt/s.

Poznámka:  

**Žádáme o zaslání podepsané smlouvy zpět na adresu poskytovatele. Nebude-li tak učiněno do 5-ti pracovních dnů od předání služby do provozu, bude služba až do doručení podepsané smlouvy poskytovateli pozastavena! (viz. (pro adresy provozované na serveru BrazdimNET s.r.o.- format jmeno@brazdim.net –  pop3: mail.brazdim.net, imap: mail.brazdim.net, – zabezpečení SSL ) O zřízení E-mailových adres je možno požádat při podpisu smlouvy, nebo kdykoli později na technické podpoře BrazdimNET s.r.o. sos@brazdim.net nebo přes www.brazdim.net v rámci rozšíření bezplatné služby.(přesnější a podrobnější nastavení může být odesláno na E-mail Účastníka po zažádání na Info, nebo SOS lince poskytovatele).

Technická podpora a kontaktní údaje

V případě nefunkčnosti některé z výše specifikovaných služeb provede poskytovatel servisní zásah do 5 pracovních dní od prokazatelného nahlášení závady na helpdesk SOS BrazdimNET s.r.o. Toto ustanovení se nevztahuje na zařízení účastníka umístěné za účastnickým rozhraním, tj. ve většině případů konektor RJ45, rozhraní ETH 10/100/1000 Mbit/s na přístupovém bodu (AP – Access Point) nebo účastnický Router u účastníka. Dále se toto ustanovení nevztahuje na případy nefunkčnosti služeb poskytovaných na síti Internet, které jsou zaviněny chybnou konfigurací vlastního zařízení účastníka, umístěných za rozhraním spoje a ani na nefunkčnost služeb poskytovaných v síti Internet či na síti Internet, které jsou zaviněny poskytovateli třetích stran těchto služeb. Jakékoli pokusy o změny konfigurace zařízení Poskytovatele, pokusy o skenování provozu, skenování hesel nebo pokus o prolomení hesel KOHOKOLI v síti INTRNET, INTRANET bude chápáno jako porušení SMLOVY a povede k okamžité výpovědi ze strany Poskytovatele. Taktéž chybná konfigurace účastníkova rozhraní, která povede k poruše jiného Účastníka je chápána jako porušení SMOLUVY. Konfiguraci přístupového bodu u účastníka provádí výhradně Poskytovatel a přístupové údaje Uživ. jméno a heslo jsou věcí provozního tajemství a nejsou běžně Účastníkovi sdělovány. Prolomení těchto hesel a jakákoli rekonfigurace je považovaná jako porušení SMLOUVY ze strany Účastníka vedoucí k postihu dle Všeobecných podmínek XII.3.1, a,b. Poskytovatel vede 24hod dohled pomocí nástrojů a technologií odpovídajících provozu a běžně používaných v těchto typech sítí. Vypínání účastnického přístupového bodu (AP) z napájení vede k planým poplachům v dohledové síti Poskytovatele. Při opakovaném vypínání bude Účastníkův přístupový bod (AP) vyjmut z dohledového sytému Poskytovatele. To způsobí nedohlížení Účastníkova přístupového bodu (AP), což může následně způsobit pozdní nebo VŮBEC žádnou reakci Poskytovatele na poruchu linky k Účastníkovi. Tato závada pak bude zjištěna buď náhodně, nebo až po ohlášení poruchy účastníkem.

Účastník je povinen ohlásit poruchu na některý z níže uvedených kontaktů a to:

Veškeré kontakty, telefon a e-mail jsou uvedeny v záhlaví a zápatí každé stránky této Smlouvy.

Účastník si je plně vědom okolnosti, že užíváním služby dává plný souhlas s úplným zněním SMLOUVY a jejích dodatků, a to i bez okamžitého podpisu smlouvy, to je, od předání služeb po montáži do provozu a užívání. Účastník svým podpisem stvrzuje, že přečetl Všeobecné podmínky a souhlasí s jejich doslovným a úplným zněním a zavazuje se je ve všech bodech dodržovat. Pokud je Účastníkovi zařízení zapůjčeno proti finanční záruce, pak je zařízení po celou dobu majetkem Poskytovatele. Pokud je v bytových domech použito zařízení Poskytovatele, je po celou dobu v majetku Poskytovatele, včetně všech kabeláží a energetických připojení, stožárů, technologických Rack skříní. Jakákoliv manipulace s tímto zařízením bude posuzována jako trestný čin a řešena právní cestou.

Smluvní strany, resp. jejich zplnomocnění zástupci, potvrzují, že výše uvedená Služba a HW zařízení byly Poskytovatelem předány zcela funkční a nepoškozené. Zařízení specifikované ve faktuře nebo tomto protokolu bylo nakonfigurované a je zcela funkční a v době předání bez jakýchkoliv závad a nedodělků. Služba SPLŇUJE veškeré nároky na ni kladené a specifikované ve Smlouvě a jejích přílohách, a zákazník vše přejímá zcela a bez výhradně. Na pozdější Reklamace a opomenutí ze strany zákazníka není možno brát žádný zřetel. Každá strana obdrží po jednom stejnopisu tohoto dodatku ke smlouvě o poskytování přístupu k síti Internet a tento dodatek číslo 1 tvoří nedílnou součást smlouvy.
